Terms of Service

These Terms govern your use of Care Spend (the “Service”), operated by Aidan George Saunders trading as Care Spend (ABN 48 583 632 219) (“Care Spend”, “we”, “our”, “us”).

By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. Definitions

Service:
the Care Spend website at care-spend.com.au and the application at app.care-spend.com.au, including all features and exports.
Account:
the credentials and profile assigned to you by Care Spend.
Your Data:
data you enter into the Service, including participant information, plans, budgets, allocations, expenses, and notes.
Subscription Fee:
the recurring fee for use of the Service, currently AUD $5 per active user per month, plus GST.

2. Eligibility

The Service is intended for:

  • Registered NDIS providers
  • NDIS support coordinators
  • Plan managers
  • Self-managed NDIS participants and their authorised representatives (e.g. family members, carers)

You must be at least 18 years old and lawfully able to enter into a contract. You are responsible for the accuracy of information you enter, and you confirm that you have the right to record any participant data you upload — under a service agreement, the NDIS Practice Standards, or as a self-managing participant.

3. Your account

You’re responsible for keeping your password confidential. You must not share your account with anyone else. If you suspect unauthorised access, contact us immediately at support@care-spend.com.au.

4. Subscription and payment

Pricing:
AUD $5 per active user per month, plus GST. Company plans available — contact us.
Billing:
Subscriptions are billed monthly in advance.
Renewal:
Subscriptions renew automatically each month unless you cancel.
Cancellation:
You may cancel at any time through your account settings or by emailing support@care-spend.com.au. Cancellation takes effect at the end of the current paid period. We do not refund the unused portion of a partial month, except where Australian Consumer Law requires us to.
Price changes:
We may change pricing with 30 days’ notice by email. Continued use after the notice period indicates acceptance. If you don’t accept, cancel before the change takes effect.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access data belonging to other users or circumvent our security
  • Share your account credentials with anyone outside your authorised team
  • Upload information you do not have the right to record or share
  • Scrape, reverse-engineer, or extract data from the Service except via our built-in export tools
  • Use the Service to misrepresent NDIS-funded amounts or provider claims
  • Interfere with or disrupt the Service or other users’ access

6. Your data

You own Your Data. We do not claim any ownership of the participant information, plans, budgets, allocations, expenses, or notes you enter.

We process Your Data on your behalf to provide the Service. Our processing is governed by our Privacy Policy.

We may use aggregated, de-identified data (information that cannot reasonably be re-associated with you or any individual) to operate, monitor, and improve the Service.

7. Intellectual property

The Service — including its software, design, logos, and copy — is owned by Care Spend or its licensors. You receive a limited, non-transferable, revocable licence to use the Service for the purposes described in these Terms.

You grant us a licence to host, store, process, and display Your Data solely to provide the Service to you.

8. Data export and portability

You may export Your Data at any time as CSV or PDF using the built-in export tools. If your account is suspended or closed, we’ll keep Your Data available for export for 30 days from the date of closure, after which it is deleted.

9. Suspension and termination

We may suspend or terminate your access if:

  • You materially breach these Terms
  • You fail to pay
  • We’re required to by law
  • We reasonably believe your use of the Service poses a security risk to other users or to the Service

We’ll give you reasonable notice and a chance to fix the issue, unless the breach is serious enough that we cannot.

10. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, which we’ll try to schedule outside Australian business hours where possible.

11. Australian Consumer Law

Our Service is supplied to you in Australia. Under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL), you have certain consumer guarantees, including that the Service is supplied with due care and skill and is reasonably fit for the purpose for which it is supplied.

These consumer guarantees apply, and nothing in these Terms excludes, restricts, or modifies them.

12. Liability

We accept the full liability imposed on us by Australian law, including under the Australian Consumer Law. We do not seek to limit our liability below the floor that Australian law sets.

To the maximum extent permitted by law (and subject to clause 11, which is paramount), we are not liable for:

  • Loss or damage caused by your unlawful use of the Service
  • Loss or damage caused by your breach of these Terms
  • Loss or damage caused by events beyond our reasonable control (force majeure)

13. Indemnity

You indemnify Care Spend from claims, damages, and costs arising from:

  • Your breach of these Terms
  • Your unauthorised use of the Service
  • Your unlawful collection or use of participant data
  • Your violation of the rights of any third party

This indemnity does not apply to the extent we are at fault.

14. Variation

We may update these Terms. We’ll give you at least 30 days’ notice of material changes by email and via the Service. Continued use after the notice period indicates acceptance. If you don’t accept a change, you may cancel without penalty before it takes effect.

15. Governing law

These Terms are governed by the laws of South Australia, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of South Australia.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.

These Terms, together with our Privacy Policy, form the entire agreement between you and Care Spend.
